1. GENERAL

1.1. These terms and conditions for your (“you”, “Participant” or the “User”) participation in The People’s SCE’s (hereinafter: “SCE”) eSync Network PoS Celebration Raffle campaign (hereinafter: raffle), under which Users participate and can win one Hardware Validator Node and two eCredits Wallet Cards (hereinafter: prize or prizes). This document does not pertain in any way to an offering of securities in any jurisdiction nor the issuance of any electronic money or other type of government backed payment instrument.
1.2. When you participate, or otherwise win a prize, you may only do so by accepting the following conditions. You warrant and represent that the following are a true and accurate reflection of the basis on which you are participating in promotion campaign, therefore You acknowledge that You:

• declare that You have read, understood and accepted “eWallet App General Terms of Service” (hereinafter referred to as the “eWallet GTS”), and associated Policies as referenced thereof;
• have registered a valid User Account pursuant to eWallet GTS, and associated Policies as referenced thereof;
• you do not reside in country which is included in the official sanctions list of the EU;
• have sufficient understanding of the functionality, usage, storage, and smart contracts in general, transmission mechanisms and intricacies associated with blockchain technology, Crypto- assets and Crypto Wallets;
• understand and accept the risks associated with blockchain technology and cryptocurrency protocols as outlined in “eWallet GTS”;
• will not hold “The People’s SCE”, its associates, employees and partners liable for any damages, loss of assets, or anything related to a particular Crypto-Asset that is part of the raffle participation.

2. ELIGIBILITY AND PARTICIPATION

2.1. To be eligible to participate in the Raffle, Participants must purchase a minimum of 10,000 eCredits (ECS) during the campaign period, complete the participation form on the campaign landing page with their Name, Email, and eCredits (ECS) Wallet Address, accept the terms and conditions, and submit the form.

2.2. Participants may enter the Raffle multiple times if they have different wallet addresses and purchase a minimum of 10,000 ECS for each wallet during the campaign period. Cumulative purchases across multiple transactions to reach the 10,000 ECS minimum are permitted.

3. DURATION

3.1. The campaign participation will be available to the eligible Users from July 11 to August 11, 2024 (herein also referred to as the “campaign period”).

3.2. The 3 winners will be drawn and informed on August 12, 2024.

4. RESTRICTIONS

4.1. Participants are permitted to participate multiple times subject to clause 2.2. of these Terms and conditions.

4.2. The People’s SCE reserves the right, at its sole discretion, to decline registration of any participation in the raffle and/or disqualify any User in case of tampering or attempt to tamper with the operation of the raffle participation (“Raffle Abuse”).

4.3. Specifically, a Raffle Abuse includes, but is not limited to:

• breach of these disclaimer, eWallet GTS or any Policy set forth on the eCredits or SCE Website.

4.4. Where there is a reasonable suspicion that the User has committed or attempted to commit a Raffle Abuse, either on their own or as part of a group, The People’s SCE reserves the right to (cumulatively or selectively):

• exclude the User form the raffle
• exclude the User from any future promotional offers;

4.5. Under no circumstances shall The People’s SCE be liable for any consequences of raffle cancellation or decline. The User acknowledges that the SCE has full discretion to draw the 3 winners of the raffle and has no obligation to send the prizes if the Users are not eligible.

4.6. The prizes are non-transferable and cannot be exchanged for cash or other item

5. SELECTION AND RECEIVING THE PRIZES

5.1. The prize winners will be randomly selected using electronic means from all eligible eCredits (ECS) Wallet Addresses submitted during the campaign period.

5.2. A number of winners will be drawn according to the prize announcement and will receive one of the prizes. Each selected winner will receive one of the prizes according to the raffle announcement. Additionally, alternate winners will be drawn to serve as replacements in the event that a prize is not accepted. A potential winner will only be deemed a winner upon their acceptance of the prize within the specified deadline. Potential winners will be notified via email. If a potential winner:

(a) cannot be achieved,

(b) does not respond within five (5) business days after the day on which the Organizer contacted him/her, or

(c) does not accept the prize,

the potential winner loses any right to receive the prize.

In such cases, the next eligible individual will be considered for the prize, and this process will continue until a winner is confirmed. Upon contacting a potential winner, verification will be conducted to ensure they have met all the requirements for participation in the campaign.

5.3. The Winners will be informed until August 12, 2024

5.4. The Winners will receive the prizes within 14 days of the draw.

6. LIMITATION OF LIABILITY

6.1. User acknowledges that the offered 2nd prize eCredits Wallet Card with an amount of 50 ‘000 ECS coins and the 3rd prize eCredits Wallet Card with an amount of 25’ 000 ECS coins. There may be price fluctuations inherent in the cryptocurrency market that don’t provide any guarantee that the value will be maintained in the future.

6.2 The People’s SCE gives no guarantees with regards to the volume, price or other specifications on secondary exchanges and no warranties with regards to any exchange service providers or the price of Crypto Assets, including ECS token, on such exchanges. The People’s SCE is not liable for any direct, indirect, incidental, special, or consequential damages or losses in profits, goods or services, which might occur due to any such price fluctuations.

6.3. In addition to the Risk and Limitation of Liability sections in the eWallets GTS, The People’s SCE shall have no liability for Crypto- Assets subject to the prizes with respect to the nature of the Crypto- Assets and their technical and legal characteristics. Each User should inquire and verify all legal and technical characteristics of each Crypto- Asset before any subscription. The User agrees that The People’s SCE shall not be liable in any way whatsoever for any damages or losses associated with any particular Crypto- Asset.

6.4. User acknowledges that The People’s SCE does not make any guarantees regarding any Crypto- Assets, correctness of the data included thereof, and does not assume any liability and/or responsibility for any representations or guarantees deriving from any Crypto-Assets, including but not limited to non-performance, non-conformance defects or errors related to the Crypto-Assets. 

6.5. If an act, omission, event or circumstance occurs which is beyond the reasonable control of The People’s SCE and which prevents The People’s SCE from complying with these terms and conditions, The People’s SCE will not be liable for any failure to perform or delay in performing its obligations.

7. PERSONAL DATA

7.1. By participating in this raffle, you consent to the collection, use, and processing of your personal data (including your name, email address, and eCredits (ECS) Wallet Address) by The People’s SCE, in accordance with the The People’s SCE privacy policy https://esync.network/privacy-policy/ , whereas in addition to purposes as outlined therein, Your personal data will be collected and used for the administration of the raffle, including the identification and notification of winners, and for compliance with legal and regulatory requirements.

8. MISCELLANEOUS

8.1. The People’s SCE reserves the right to cancel, withdraw, terminate, or temporarily suspend the raffle or amend this disclaimer at any time, in case of unavoidable circumstances beyond The People’s SCE’s control that make it necessary and to the extent this would not be unfair or will not disadvantage those who sought to participate within the original terms. The Users will be notified via the registered email address.

8.2. In the above cases, The People’s SCE bears no responsibility towards the Users who participate are not able to request the completion or continuation of the raffle and/or to claim damages.

8.3. If any of the above cases occur, any User that wishes to withdraw its participation in the raffle shall send an email to [email protected], stating explicitly that it wishes to withdraw its participation. If the Users do not withdraw their participation by following the above procedure, their participation in the raffle will be considered valid, and it will imply that they tacitly and unconditionally accept the terms and conditions of the bonus participation, as these are amended.

8.4. This campaign disclaimer shall be governed by the laws of Luxembourg and any disputes will be subject to the exclusive jurisdiction of the Courts of Luxembourg.
